By accessing or using www.disheswithdel.com and related sites operated by us (collectively, the "Site"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use the Site.

1. OWNERSHIP OF CONTENT & LICENSE

• All content on the Site, including text, videos, training materials, images, recipes, products, services, designs, graphics, software, audio, and other materials ("Content") is the property of Dishes With Del or our third-party providers.

• We grant you a limited, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial use only.

• You may not copy, reproduce, republish, upload, transmit, distribute, or modify any Content without our prior written consent. Unauthorized use may violate copyright, trademark, and other laws.

• All course materials, including The Reliable Sourdough Method course content, are for your personal use only. You may not share, resell, or redistribute course materials.

• All Content is protected by copyright unless otherwise stated.

• All trade names, trademarks, logos, and brand assets (including "Dishes With Del") are owned by or licensed to us.

• Nothing in these Terms grants you the right to use our trademarks without prior written permission.

3. ELIGIBILITY & AGE RESTRICTIONS

• The Site is intended for individuals 18 years or older.

• If you are under 18, you may only use the Site with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms.

• By using the Site, you confirm that you meet these age requirements.

4. USER CONDUCT

You agree not to:

• Share, sell, or transfer your login credentials
• Access courses or memberships on behalf of others without authorization
• Copy, resell, or redistribute recipes, course materials, or videos
• Record, screenshot, or download course videos for redistribution
• Scrape, hack, or interfere with the operation of the Site
• Post unlawful, defamatory, offensive, or infringing content
• Spam, harass, or promote unauthorized products/services in The Cook's Table Community
• Use the Site for any illegal or unauthorized purpose
• Impersonate another person or entity

Violation may result in immediate suspension or termination of access without refund.

5. REGISTRATION & COMMUNICATIONS

• By registering with us, you consent to receive electronic communications (emails, notices, disclosures, updates, course materials).

• You are responsible for maintaining the confidentiality of your account credentials.

• You agree to notify us immediately of any unauthorized use of your account.

• You may opt out of marketing emails at any time by following unsubscribe instructions. However, you cannot opt out of essential transactional emails related to your course access and purchases.

6. PAYMENTS, REFUNDS & ACCESS

Pricing

• All prices are listed in New Zealand Dollars (NZD) unless otherwise stated.

• Prices are subject to change without notice, but changes will not affect orders already placed.

• Discount codes are non-transferable and cannot be combined with other offers unless explicitly stated.

Payment

• Payment is required at the time of purchase via Stripe, PayPal, or other approved payment processors.

• By providing payment information, you authorize us to charge your payment method for the purchase amount.

Refund Policy

• We offer a 14-day money-back guarantee for course purchases. NOT on other digital products.

• If you are not satisfied with a course, you may request a full refund within 14 days of purchase by emailing [email protected]

• Refunds will be processed within 5-7 business days to your original payment method.

• After 14 days, all sales are final. No refunds will be issued.

• To request a refund, you must not have completed more than 50% of the course content.

• Refunds are provided at our discretion and may be denied for abuse of the refund policy.

Access

• Course access is provided for lifetime (as long as the course is commercially available).

• We reserve the right to discontinue any course with 30 days' notice. Active students will be notified and may receive alternative arrangements.

• Membership or subscription access is provided for the duration of your active subscription.

• Sharing login credentials or granting access to non-paying users is strictly prohibited and may result in account termination without refund.

7. COURSE & MEMBERSHIP TERMS

The Reliable Sourdough Method

• One-time payment provides lifetime access to all course materials.

• Includes access to The Cook's Table Community as a bonus (subject to community guidelines).

• Course content may be updated or improved over time at our discretion.

The Cook's Table Community

• Free access for course purchasers; may become a paid subscription in the future.

• Current course purchasers will be grandfathered in or offered alternative arrangements if community becomes paid.

• You must follow community guidelines. We reserve the right to remove members who violate guidelines.

Digital Products

• All digital products (e-books, PDFs, guides) are for personal use only.

• You may not resell, redistribute, or share digital products.

8. SUGGESTIONS & SUBMISSIONS

• Any comments, ideas, testimonials, photos, or materials you submit to us (e.g., recipe ideas, suggestions, course feedback, success stories) become the property of Dishes With Del.

• We may use your submissions for commercial, promotional, or educational purposes without obligation to compensate you.

• By submitting content, you grant us a perpetual, worldwide, royalty-free license to use, modify, and display your submission.

• You confirm that your submissions do not infringe on the rights of any third party.

9. PRIVACY, DATA PROTECTION & COOKIES

• Your use of the Site is also governed by our Privacy Policy at www.disheswithdel.com/privacy-policy.

• We process personal data in accordance with the New Zealand Privacy Act 2020.

• The Site uses cookies and similar technologies to improve functionality, analyze traffic, and personalize your experience.

10. COMMUNITY & SOCIAL MEDIA RULES

If you participate in The Cook's Table Community or our social media groups:

• Be respectful to others. No harassment, hate speech, bullying, or offensive behavior.

• No self-promotion, affiliate links, or solicitation without written permission from Dishes With Del.

• No spam or irrelevant content unrelated to sourdough baking or cooking.

• Share your wins, ask questions, and support fellow bakers!

• We reserve the right to remove posts or members at our sole discretion.

• Community guidelines may be updated and will be posted in the community.

11. DISCLAIMERS & LIMITATION OF LIABILITY

No Warranty

• The Site and Content are provided "as is" without warranties of any kind, express or implied.

• We make no guarantees regarding:
- Specific baking results or outcomes
- Uninterrupted or error-free operation of the Site
- Accuracy or completeness of Content
- Compatibility with all devices or browsers

Educational Purposes Only

• Our courses and content are for educational purposes only.

• Results may vary based on your effort, skill level, ingredients, equipment, and environmental factors.

• We are not responsible for any food safety issues, allergic reactions, or injuries resulting from following our recipes or techniques.

• You are responsible for following proper food safety practices.

Limitation of Liability

• To the maximum extent permitted by New Zealand law, Dishes With Del shall not be liable for any:
- Indirect, incidental, special, or consequential damages
- Loss of profits, revenue, data, or goodwill
- Damages arising from your use of the Site or inability to access the Site
- Damages from errors, omissions, or technical failures

• Our total liability to you for any claim related to the Site shall not exceed the amount you paid for the product or service giving rise to the claim (maximum NZD $60.00 for course purchases).

• Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such cases, our liability will be limited to the maximum extent permitted by law.

12. THIRD-PARTY SERVICES

• We use third-party services including:
- Kajabi (course hosting platform)
- Stripe and PayPal (payment processing)
- Email service providers
- Analytics and tracking tools

• We are not responsible for issues caused by third-party providers.

• Any disputes with third-party services must be resolved directly with those providers.

• Links to third-party websites are provided for convenience only. We do not endorse or control third-party sites.

13. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Dishes With Del, its owner Adele Holland, and any employees, contractors, or agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:

• Your use of the Site
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Your submission of content to the Site
• Your breach of any representation or warranty in these Terms

14. DISPUTE RESOLUTION

Informal Resolution

• Before filing any legal claim, you agree to first attempt to resolve the dispute with us informally by contacting [email protected]

• We will attempt to resolve disputes promptly and in good faith.

Mediation

• If informal resolution fails, disputes shall be submitted to mediation in accordance with the Resolution Institute Standard Mediation Agreement.

• Mediation shall take place in New Zealand (location to be agreed).

• Each party will bear their own costs of mediation.

Arbitration

• If mediation fails, disputes shall be resolved by binding arbitration under the Arbitration Act 1996 (New Zealand).

• Arbitration shall be conducted by a single arbitrator appointed by agreement of the parties or, failing agreement, by the Resolution Institute.

• The arbitration shall take place in New Zealand.

• The decision of the arbitrator shall be final and binding.

Class Action Waiver

• You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

17. GOVERNING LAW & JURISDICTION

• These Terms are governed by and construed in accordance with the laws of New Zealand.

• The New Zealand Consumer Guarantees Act 1993 and Fair Trading Act 1986 apply to these Terms.

• You agree to submit to the non-exclusive jurisdiction of the courts of New Zealand.

• If you are a consumer, this does not affect your rights under New Zealand consumer protection laws.

16. INTELLECTUAL PROPERTY INFRINGEMENT

• We respect the intellectual property rights of others.

• If you believe your work has been infringed on our Site, please contact us at [email protected] with:

- A statement of good faith belief that use is not authorized

18. TERMINATION

By You

• You may terminate your account at any time.

• Termination does not entitle you to a refund unless within the 14-day refund period.

By Us

- Engage in fraudulent activity
- Abuse the refund policy
- Harass other users or staff
- Share login credentials
- Use the Site in any way that causes harm

• Upon termination, your license to use the Site and access Content will immediately cease.

• Sections of these Terms that by their nature should survive termination will survive (including payment obligations, disclaimers, and limitation of liability).

18. SEVERABILITY

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

21. ASSIGNMENT

You may not assign or transfer these Terms or your rights under these Terms. We may assign these Terms without restriction.

22. CHANGES TO TERMS

• We may update these Terms of Service at any time without prior notice.

• Updates will be posted on this page with a revised "Last Updated" date.

• Continued use of the Site after changes constitutes acceptance of the updated Terms.
